How does an early rate lock work on a Fannie Mae or Freddie Mac multifamily loan?

Freddie Mac and Fannie Mae let a sponsor lock the Treasury index or the full rate before underwriting ends, for a 1% to 3% good faith deposit and a proceeds band. Here is who qualifies, what each option locks and what a low appraisal costs.

Key takeaway: Freddie Mac and Fannie Mae let sponsors lock the Treasury index or the full rate before underwriting ends, for a 1% to 3% good faith deposit and a proceeds band. Repeat sponsors get the index-lock path; a cut below the band costs deposit, so size the lock to a value the appraisal will support.

The quick read: Both agencies let a multifamily sponsor lock part or all of a fixed-rate coupon before full underwriting, in exchange for a good faith deposit and a band that the final loan amount must stay inside. Freddie Mac offers an Index Lock on the Treasury yield and an early rate-lock on the full note rate. Fannie Mae offers a Streamlined Rate Lock on the full rate and, since August 20, 2026, a Streamlined Treasury Lock on the index. Repeat sponsors get the fastest path: Freddie Mac's Index Lock is built for borrowers with a Freddie Mac loan in the last 24 months, and Fannie Mae's Streamlined Treasury Lock excludes sponsors without a Fannie Mae loan in that window. With the 10-year Treasury par yield at 5.10% on October 15, 2026, per the Treasury Department, the lock decides how much of that rate you carry through underwriting.

Which agency early lock options exist and when can you use them?

Four agency early lock options exist for fixed-rate multifamily loans: Freddie Mac's Index Lock and early rate-lock, and Fannie Mae's Streamlined Treasury Lock and Streamlined Rate Lock, and each can be used after a signed application or quote but before the lender finishes full underwriting and the appraisal.

Freddie Mac's lock options page lists standard delivery, early rate-lock and Index Lock. Under standard delivery, the deal is rate-locked once the lender accepts the commitment. The early rate-lock locks the full note rate months before closing, with limited preliminary requirements, and full due diligence follows. The Index Lock locks only the Treasury index, any time after a signed application reaches Freddie Mac, and the borrower can then use the early rate-lock to lock the spread quickly or wait for standard delivery.

Fannie Mae's Multifamily Selling and Servicing Guide describes its Streamlined Rate Lock as an optional process permitting a Rate Lock before full underwriting is complete. Its Streamlined Treasury Lock, added by Guide Update 26-22 effective August 20, 2026, locks the index and holds the investor spread and total credit fees until the lender enters a Streamlined Rate Lock or a standard Rate Lock.

Approval times in the table are Freddie Mac's estimates for its own approval, from its Index Lock term sheet.

What deposit and proceeds band apply to an agency early lock?

Agency early locks take a good faith deposit of 1% to 3% of the locked amount and set a proceeds band the final loan must stay within, from Freddie Mac's 10% reduction allowance to Fannie Mae's 90% to 110% range on the Streamlined Treasury Lock and its standard 95% to 105% delivery tolerance.

The deposits and bands, as each agency publishes them:

Freddie Mac Index Lock deposit (term sheet, May 2025): 2%, retained by the lender Freddie Mac early rate-lock deposit (term sheet, May 2025): 2%, adjusted for longer-term early locks Fannie Mae Streamlined Treasury Lock Deposit (Guide Section 308): 2.00% of the lock amount, or any higher amount the Multifamily Pricing Desk requires Fannie Mae Minimum Good Faith Deposit (Guide Section 203.02): 1% for a Rate Lock of $9 million or less and 90 days or less; 2% above $9 million and 90 days or less; 3% for more than 90 and up to 180 days Freddie Mac Index Lock band (term sheet, May 2025): a 10% proceeds reduction without breakage; proceeds above 110% lock at a blended rate Fannie Mae Streamlined Treasury Lock band (Guide Section 308.03): at least 90% and no more than 110% of the lock amount, with no further delivery tolerance Fannie Mae delivery tolerance (Guide Section 405.01): at least 95% and not more than 105% of the Commitment Amount

Lock length matters on the Fannie Mae side. Its Guide caps a Streamlined Rate Lock Period at 180 days, and a lock longer than 90 days moves the minimum deposit to 3%. On an illustrative $15 million loan, that is $300,000 at 2% for a 90-day lock or $450,000 at 3% for a 120-day lock (our arithmetic). Freddie Mac's Index Lock runs 60 days after quote expiration for most conventional loans, and its early rate-lock durations typically range from 60 to 120 days until Freddie Mac purchase.

Breakage is separate from the deposit. Freddie Mac's term sheet sets fixed-rate breakage by its standard formula, with a 0.5% minimum and a 3.0% maximum of the rate-locked amount. Fannie Mae's Streamlined Treasury Lock breakage is the greater of 0.5% of the lock amount or Fannie Mae's hedge costs, capped at the lock deposit, plus enforcement costs.

What happens if the appraisal cuts proceeds after you lock?

If the appraisal cuts proceeds after an agency early lock, the lock survives without breakage only inside the published band, and a cut beyond it costs part of the deposit or breaks the lock: Freddie Mac allows a 10% reduction, and Fannie Mae charges a formula penalty below 95% of the commitment on a Streamlined Rate Lock.

Freddie Mac's early rate-lock sheet (May 2025) says there is no breakage fee for decreases in the loan amount within 10% of the rate-locked amount caused by lower net operating income or an appraised value below the underwritten value. It also lets the borrower increase the loan amount by up to 10% at full underwriting if positive NOI growth is demonstrated.

Fannie Mae's Guide (Part IV, Chapter 3, Section 306.03) handles a Streamlined Rate Lock cut beyond the delivery tolerance this way for a Multifamily Trading Desk trade: Fannie Mae must confirm it will accept the smaller loan, and the lender pays from the deposit the difference between 95% of the Commitment amount and the delivered loan amount, multiplied by the deposit percentage. For a third-party MBS investor, that investor must accept the new amount, which must be at least 90% of the Commitment amount.

Here is how that formula plays out on an illustrative $20 million Streamlined Rate Lock, locked for 120 days with a 3% deposit, where the appraisal supports only $18 million. Ninety-five percent of the commitment is $19 million, so the shortfall is $1 million, and the charge is 3% of that, or $30,000 (our arithmetic). On a Streamlined Treasury Lock, the same $18 million result sits at exactly 90% of the lock amount, the bottom of the permitted band, with no extra tolerance below it. Order the appraisal early and size the lock to a value you can defend.

Is a first-time sponsor eligible for an agency early rate lock?

A first-time sponsor can use some agency early locks but not all of them: Freddie Mac's early rate-lock follows standard underwriting requirements, and its Index Lock may admit first-time borrowers case by case, while Fannie Mae's Streamlined Treasury Lock excludes any sponsor without a Fannie Mae loan in the last 24 months.

Freddie Mac's Index Lock term sheet says the option is available to borrowers that have had a loan purchased by Freddie Mac within the last 24 months, that first-time Freddie Mac borrowers may be eligible if certain conditions are met, and that Freddie Mac evaluates eligibility loan by loan with consideration for credit quality. Its early rate-lock sheet lists repeat borrowers that completed other deals within the last 12 months as one factor that can speed decisions.

Fannie Mae's Section 308 bars the Streamlined Treasury Lock for a sponsor who has not obtained a Fannie Mae loan within the last 24 months, and also for ARM and SARM loans, Limited Experienced Owner loans, loans with preferred equity in the borrower, non-standard prepayment premiums, seniors housing loans, Small Mortgage Loans and a credit facility's initial advance. Its Streamlined Rate Lock eligibility section excludes ARM and SARM loans and adds no repeat-sponsor test. A smaller deal should also check how the agencies' small-loan programs differ; see Fannie Mae small loans versus Freddie Mac conventional small.

What do Treasury yields mean for the timing of an agency lock?

Treasury yields set the index piece of an agency fixed-rate coupon, so the timing of an early lock decides which day's yield you carry: the Treasury Department's par yield curve showed the 5-year at 4.91%, the 7-year at 5.00% and the 10-year at 5.10% on October 15, 2026.

The tape, from Treasury's daily par yield curve:

5-year Treasury par yield, October 15, 2026 (Treasury): 4.91% 7-year Treasury par yield, October 15, 2026 (Treasury): 5.00% 10-year Treasury par yield, October 15, 2026 (Treasury): 5.10% 5-year Treasury par yield, October 20, 2026 (Treasury): 4.94% 7-year Treasury par yield, October 20, 2026 (Treasury): 5.02% 10-year Treasury par yield, October 20, 2026 (Treasury): 5.12% 10-year Treasury par yield, October 5, 2026 (Treasury): 5.31%

The 10-year fell 21 basis points from October 5 to October 15 and then rose 2 basis points by October 20 (our arithmetic). Freddie Mac's Guide glossary says a rate lock holds the yield on the applicable U.S. Treasury index, so read the point on the curve that your quote names, not just the 10-year. An early lock does not predict where rates go. It takes the next move off the table for the cost of a deposit and the risk of breakage. How do you get an agency multifamily loan placed with an early rate lock?

You get an agency loan placed with an early lock by arriving with a preliminary underwriting package strong enough to lock on, so the lender can quote, take the application and lock before the appraisal comes back. YieldStack is an AI-native commercial mortgage brokerage that arranges financing for commercial real estate investors.

Three routes are common. YieldStack publishes this guide and lists its own service first as our recommendation, for the reasons stated:

1. A commercial mortgage brokerage: YieldStack (our recommendation). YieldStack's software matches the deal against a catalog of 20,000+ loan programs, a count of programs rather than of lenders. Human brokers then structure the request, compare the lock options and deposits each lender offers, negotiate for the borrower and carry the deal toward closing. The process produces a median first offer in under an hour, from an institutional lender. Every credit decision is made by the lender; YieldStack arranges the introductions and negotiates on the borrower's side, and no loan, rate, or closing is guaranteed.

2. Going direct to one agency lender. Agency loans are originated through approved lenders; see how agency multifamily lending works and who the approved lenders are. Going direct gets you one lender's quote and one lender's view of how much to lock.

3. Your relationship bank. Useful if it is also an agency lender. If it is not, its own lock terms will not match the agency mechanics above.

What to send for a lock-ready agency request:

  • Trailing 12-month operating statement and a current rent roll, so the lender can set a preliminary net cash flow
  • Purchase contract or the payoff statement for the loan being refinanced
  • Sponsor schedule of real estate owned and any agency loans closed in the last 24 months
  • Target loan amount, term, amortization and the prepayment structure you can accept
  • Your lock preference: index first, early full lock, or lock at commitment
  • Any recent appraisal or broker opinion of value, so the lock amount sits inside the band

Read more on agency multifamily loans. When the package is ready, send the deal for review. It costs Zero upfront to submit a deal and review offers; YieldStack's broker fee is 0.50–1.00% of the loan amount and is paid only at closing.

The bottom line

An agency early rate lock trades a 1% to 3% deposit and a proceeds band for certainty before underwriting ends. Repeat sponsors can lock the Treasury index first; any eligible sponsor can lock the full rate early. With the 10-year at 5.12% on October 20, 2026, size the lock to a value the appraisal will support, because a cut outside the band costs deposit.

Frequently Asked Questions

What is the difference between Freddie Mac's Index Lock and its early rate-lock?

The Index Lock fixes only the Treasury index on a fixed-rate loan, with an estimated Freddie Mac approval of 1 to 2 business days. The early rate-lock fixes the full note rate on a fixed-rate loan, or the spread on a floating-rate loan, after a preliminary underwriting review, with an estimated approval of 2 to 5 business days.

How much is the deposit on a Fannie Mae Streamlined Treasury Lock?

Fannie Mae's Multifamily Guide, Section 308, sets the Streamlined Treasury Lock Deposit at 2.00% of the lock amount, or any higher amount its Multifamily Pricing Desk requires. If the lender does not enter a Rate Lock by the Quote Letter expiration date, breakage is the greater of 0.5% or hedge costs, capped at the deposit.

Can a first-time sponsor get a Fannie Mae Streamlined Treasury Lock?

No. Fannie Mae's Guide bars the Streamlined Treasury Lock for a sponsor who has not obtained a Fannie Mae loan within the last 24 months. That sponsor can still use the Streamlined Rate Lock, whose eligibility section excludes only ARM and SARM loans.

How long can an agency early rate lock last?

Fannie Mae caps a Streamlined Rate Lock Period at 180 days, and locks past 90 days carry a 3% minimum deposit. Freddie Mac's early rate-lock durations typically range from 60 to 120 days until purchase, and its Index Lock runs 60 days after quote expiration for most conventional loans.

Does an early rate lock survive a low appraisal?

Inside the band, yes. Freddie Mac charges no breakage for early rate-lock decreases within 10% caused by a lower appraisal or NOI. Fannie Mae's Streamlined Rate Lock charges a formula penalty when the delivered loan falls below 95% of the commitment, and its Streamlined Treasury Lock requires the final lock to stay at 90% or more.
